PRIVACY POLICY



This is the privacy and cookies policy for www.letsgetout.com and the Let's Get Out ("letsgetout") application. For the purposes of this privacy policy, both the website and the application shall be referred to as the "App". This App is owned, developed and operated by Golden Trident Limited registered in the UK. For the purpose of this policy (we, us and our) refers to the aforementioned limited company. We are committed to protecting your privacy on-line. We appreciate that you do not want the personal information you provide to us distributed indiscriminately and here we explain how we collect information, what we do with it and what controls you have. We are registered with the UK Information Commissioner, under the no. ZA118293. For the purposes of the Data Protection Act 1998, we are the data controller.

Please note that by using the App, you consent to the collection and use of information in accordance with this privacy policy. We reserve the right to change this privacy policy from time to time by changing it on the App. This privacy policy was last updated on August 14, 2015.



1. Information Collection

1.1 We may collect following information about you and your use of our Website, mobile applications, platform and service (together, our "App") in order to create an accurate and personalized experience for our users:

  1. Any Personal information obtained when you Sign up (or when log in using your social networking account), such as your full name, any associated user id or user name or nickname, profile picture, gender, date of birth, email address, location or country;
  2. Any information that you provide by completing any forms on the App, including if you register as a user of the App with your email and password, subscribe to any service, upload or submit or publish any material or information via the App, request any information or enter into any competition or promotion we may sponsor;
  3. Your preferences, which helps us provide you with more tailored experience or offers;
  4. All communications you send to us, for example to report a problem, bug or to submit queries, concerns or comments regarding the App or its content;
  5. Information from surveys that we may, from time to time, run on the App for research purposes, if you choose to respond to them;
  6. Details of your visits to the App, your activity, the resources you access and any data you view or download;
  7. Various "Personally Identifiable Information", which for purposes of this Policy means information that could be used to identify you personally (such as your email address or IP address), which has not been previously or subsequently disclosed by you on the public areas of our App or in messages or communications you send within the App or directly to us.
  8. Various “Non-personal data” which for purposes of this Policy means information that does not directly identify you. Additionally, non-personal data means “aggregate” and “de-personalized” information, which is data we collect about the use of our services, from which any personally identifiable data has been removed. We may use any tools or third party analytical software or services to automatically collect, store and use certain non-personal data that does not directly enable us to identify you. The types of non-personal data we may collect and use include, but are not limited to:
    1. device properties, including, but not limited to IP address, Media Access Control (“MAC”) address and unique device identifier or other device identifier ("UDID");
    2. device software platform and firmware;
    3. mobile phone carrier;
    4. geographical data such as post code and coarse location;
    5. other non-personal data as reasonably required by us to enhance our products and services.
    6. any software reports and logs generated by the App which are sent automatically and anonymously to us about its general state, usage and performance;


1.2 In order to get the most out of our service and to allow us to provide you with relevant activities, we need to know your approximate geographic location ("Geolocation") from time to time. The types of location data that will be processed are your latitude, longitude, cell tower ID, etc.

1.3 Our App, website or third party partners might use cookies to store certain information. Cookies are pieces of information that a website transfers to your hard drive to store and sometimes track information about you. Although they do identify a user's device, cookies do not personally identify users. Cookies are specific to the server that created them and cannot be accessed by other servers, which means they cannot be used to track your movements around the internet. For more information about how we use cookies and other tracking devices, please refer to our Cookie Policy (Section 8).


2. Use of Information

2.1 We use the information we collect about you (including your Personally Identifiable Information) to create a better, more personalized experience for you based on your individual usage habits, improve our marketing and promotional efforts, analyse site usage, improve our content and product offerings, and customize our App content, layout and Services. These uses improve our site and allow us to better customize it to meet your needs. We also use the information we collect about you to resolve disputes, troubleshoot problems, and enforce our Terms of Use Agreement.

2.2 We may compile the information we collect about you and use it, in an aggregate form only, in the negotiation and establishment of service agreements with public and/or private enterprises under which such enterprises will serve as Let's Get Out partners or as venues for meetings between our members ("Activity").

2.3 We may use for promotional, sales or any use that we consider appropriate your correspondence with us or photographs submitted for publication on our App, be it via email, postings on our website, or via our mobile application. Our use of such materials is consistent with the restrictions on disclosure of Personally Identifiable Information set forth in Section 6.

2.4 Your geographic location ("Geolocation") data will only be processed for as long as necessary in order for us to respond to your request on the App. We do not store this data on our systems. However, your data may be transferred to our partners, third party servers, service providers or merchants for the purpose of providing you with the most accurate activities at that time to match your preferences. There is no guarantee that a third party or partner will not collect or process such information on their systems.


3. Information sharing, storage and security

3.1 We are using a third party mobile backend service provider Parse.com by Facebook Inc ("Parse") for our App data storage and data processing (http://www.parse.com). You must be aware that any information you submit via our App could be sent to and stored and processed on secure servers provided by Parse which may be situated outside the European Economic Area and may be processed by staff operating outside the European Economic Area. We do not have any control on how and where the data is being stored or processed by Parse servers. By using the App, you are implicitly giving your consent for any collected information about you to be sent, stored and processed on Parse servers and recognise that we have to fully comply with their terms and policies.

3.2 Some of your information and data you submit or publish on the App are clearly intended to be available and accessible publicly by all the end users of the App. These include your name, profile picture, your activities, the date, time and physical location of an activity or a place where you are going to be, any audio visual content or data you publish as well as all your posts and comments in the App. You should exercise caution when publishing any content publicly on the App and never disclose any personal information that you do not wish to be published or revealed in public. Submission of any private information and data in intended public areas of the App is done fully at your own risk.

3.3 Internet security is a complex issue and no system can be considered 100% secure. We place great importance on the security of all personally identifiable information associated with our users. We have security measures in place to attempt to protect against the loss, misuse and alteration of personal information under our control. Whilst we cannot ensure or guarantee that loss, misuse or alteration of information will never occur, we use all reasonable efforts to prevent it. You should also bear in mind that submission of information over the internet is never entirely secure. We cannot guarantee the security of information you submit via the App whilst it is in transit over the internet and any such submission is at your own risk.


4. External links

4.1 The App may, from time to time, contain links to external sites. We are not responsible for the privacy policies or the content of such applications or sites.


5. Disclosure of Your Information

5.1 Opt-in requirement: WITHOUT YOUR AFFIRMATIVE CONSENT (ON A CASE-BY-CASE BASIS), WE DO NOT SELL, RENT OR OTHERWISE SHARE YOUR PERSONALLY IDENTIFIABLE INFORMATION WITH OTHER THIRD PARTIES, UNLESS OTHERWISE REQUIRED AS DESCRIBED BELOW UNDER "REQUIRED DISCLOSURES". TO THE EXTENT WE SHARE INFORMATION WITH OUR PARTNERS AND ADVERTISERS, WE SHARE ONLY AGGREGATED OR OTHERWISE NON-PERSONALLY IDENTIFIABLE INFORMATION THAT IS NOT LINKED TO YOUR PERSONALLY IDENTIFIABLE INFORMATION. Aggregated information that we may share with our marketing partners includes, but is not limited to, information showing the relative popularity of one activity over another, or the popularity of certain activity topics.

5.2 You should understand that information you provide through the registration process or post to the public areas of our App, or through the use of our services (including your name (if provided) and location information) may be accessible by and made public through syndication programs and by search engines, metasearch tools, crawlers, metacrawlers and other similar programs.

5.3 Required disclosures: Though we make every effort to preserve member privacy, we may need to disclose your Personally Identifiable Information when required by law or if we have a good-faith belief that such action is necessary to:

  1. comply with a current judicial proceeding, a court order or legal process served on our website,
  2. enforce this Policy or the Terms of Use Agreement,
  3. respond to claims that your Personal Information violates the rights of third parties; or
  4. protect the rights, property or personal safety of our company, the App and its users and the public. You authorize us to disclose any information about you to law enforcement or other government officials as we, in our sole discretion, believe necessary or appropriate, in connection with an investigation of fraud, intellectual property infringements, or other activity that is illegal or may expose us or you to legal liability.


6. Reviewing, Updating, Deleting and Deactivating Personal Information

6.1 When you agree to log in via your social networking account, the required personal information about you is retrieved and stored on our servers, accuracy of which depends on your social networking profile. There is no guarantee that our App will be able to accurately detect any updates or changes made to your profile information automatically on regular basis. If you think that we hold any inaccurate or misleading information about you, we can be contacted directly so that your information can be updated accordingly.

6.2 Upon your request, we will deactivate your account and remove your Personally Identifiable Information from our active databases. To make this request, you need to contact us directly using the information given at the end of this policy. Upon our receipt of your request, we will deactivate your account and remove your Personally Identifiable Information as soon as reasonably possible in accordance with our deactivation policy and applicable law. Nonetheless, we will retain in our files information you may have requested us to remove if, in our discretion, retention of the information is necessary to resolve disputes, troubleshoot problems or to enforce the Terms of Use Agreement. Furthermore, your information is never completely removed from our databases due to technical and legal constraints (for example, we will not remove your information from our back up storage). We also cannot guarantee that your data will be fully removed from the servers managed by third parties, partners or service providers (e.g Parse)


7. Your rights

7.1 You have a legal right under the Data Protection Act 1998 to a copy of all the personal information about you held by us. On request, we will provide you with a copy of this information subject to a fee not exceeding £10. You also have a right to prevent the use of your personal information for direct marketing purposes.

7.2 You have a right to correct any errors in your personal information we hold about you as mentioned in section 6 above.

7.3 You can choose not to allow us to process your approximate geographic location ("Geolocation") at the time you connect to the App, or any time after that either by changing the settings on your mobile device or by contacting us using the contact details at the end of this privacy policy. Please note that if you choose not to allow us to process your location data, we will not have enough data in order to provide you with any of our services.

7.4 You are under no obligation to provide any of the information we may request. However, if you should choose to withhold requested information, we may not be able to provide you with certain services on our App.


8. Our Cookie policy

When you use our App, our Web server sends a cookie to your computer or mobile device (depending on how you access the App). Cookies are small pieces of information which are issued to your computer when you visit a website and which store and sometimes track information about your use of the site. A number of cookies we use last only for the duration of your web session and expire when you close your App. These are known as session cookies. Other cookies are used to remember you when you return to the App and will last for longer. These are known as persistent cookies. We use cookies to:

  1. remember that you have visited us before; this means we can identify the number of unique visitors we receive. This allows us to make sure we have enough capacity for the number of users that we get;
  2. customise elements of the promotional layout and/or content of the pages of the site; and
  3. collect statistical information about how you use the site so that we can improve the site and learn which parts of the website are most popular to visitors.

Some of the cookies used by our App are set by us, and some are set by third parties who are delivering services on our behalf. For example, social networking sites. Most web browsers automatically accept cookies but, if you prefer, you can change your browser to prevent that or to notify you each time a cookie is set. Please note however, that by blocking or deleting cookies used on the site you may not be able to take full advantage of our App if you do so. In addition to cookies, tracking Gifs may be set by us or third parties in respect of your use of the site. Tracking Gifs are small image files within the content of our site or the body of our newsletters so we or third parties can understand what parts of the website are visited or whether particular content is of interest.


9. Notification of Changes

9.1 If we decide to change this Policy, we will post those changes on www.letsgetout.com/privacy or post a notice of the changes to this Policy on the homepage (www.letsgetout.com) and other places we deem appropriate, so you are always aware of what information we collect, how we use it, and under what circumstances, if any, we disclose it. We will use information in accordance with the Privacy Policy statement under which the information was collected.

9.2 If we make any material changes in our privacy practices, we will post a prominent notice on our website notifying you and our other members of the change. In some cases where we post a notice we will also email you and other members who have opted to receive communications from us, notifying them of the changes in our privacy practices. However, if you have deleted/deactivated your account, then you will not be contacted, nor will your previously collected personal information be used in this new manner.

9.3 Any changes to this Policy (i.e., if it does not change how we treat your Personally Identifiable Information) will become effective after we provide you with at least thirty (30) days notice of the changes and provide notice of the changes as described above. You must notify us within this 30 day period if you do not agree to the changes to the Policy and wish to deactivate your account as provided under Section 6.


10. Dispute Resolution

Any dispute, claim or controversy arising out of or relating to this Policy or previous Privacy Policy statements shall be resolved through negotiation, mediation and arbitration as provided under our Terms of Use Agreement.
